Agreement to Terms

These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and EJay Mobile Services ("we," "us" or "our"), concerning your access to and use of our services.

You agree that by accessing our services, you have read, understood, and agree to be bound by all of these Terms of Service. If you do not agree with all of these Terms of Service, then you are expressly prohibited from using our services and must discontinue use immediately.

Services

EJay Mobile Services provides auto detailing and roadside assistance services. By using our services, you agree to the following terms:

  • You must provide accurate and complete information when scheduling services.
  • You must be the owner of the vehicle or have permission from the owner to authorize services.
  • You must provide a safe and accessible location for our technicians to perform the requested services.
  • You understand that certain services may require additional time or materials, which may result in additional charges.
  • You agree to pay for all services rendered at the agreed-upon price.

Appointments and Cancellations

We strive to provide timely and efficient service. To help us maintain our schedule and serve all customers effectively, we have the following appointment and cancellation policies:

  • Appointments must be scheduled at least 24 hours in advance, subject to availability.
  • If you need to cancel or reschedule an appointment, please notify us at least 24 hours in advance.
  • Late cancellations (less than 24 hours notice) may be subject to a cancellation fee of up to 50% of the scheduled service.
  • No-shows (failure to appear for a scheduled appointment without notice) may be subject to a fee equal to the full amount of the scheduled service.
  • We reserve the right to reschedule appointments due to inclement weather, equipment failure, or other unforeseen circumstances.

Payment Terms

Payment is due at the time services are rendered, unless otherwise agreed upon in writing. We accept the following payment methods:

  • Cash
  • Credit/Debit Cards (Visa, MasterCard, American Express, Discover)
  • Mobile Payment Apps (Apple Pay, Google Pay, Venmo, Cash App)

For certain services, we may require a deposit at the time of scheduling. Deposits are non-refundable in the event of a late cancellation or no-show.

Service Guarantees and Limitations

We take pride in the quality of our work and strive for customer satisfaction. However, please note the following limitations:

  • We guarantee our detailing services for 24 hours after completion. If you are not satisfied with any aspect of our service, please contact us within this timeframe, and we will address your concerns at no additional cost.
  • We are not responsible for pre-existing damage to your vehicle, including but not limited to scratches, dents, chips, or mechanical issues.
  • Some stains, odors, or damage may be permanent and cannot be completely removed through our services.
  • Roadside assistance response times may vary based on location, traffic, weather conditions, and service demand.
  • We reserve the right to refuse service if we determine that a requested service may cause damage to your vehicle or if conditions are unsafe for our technicians.

Intellectual Property

The EJay Mobile Services name, logo, website, and all content, features, and functionality are owned by EJay Mobile Services and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

Limitation of Liability

In no event shall EJay Mobile Services, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your use of or inability to use our services;
  • Any unauthorized access to or use of our servers and/or any personal information stored therein;
  • Any interruption or cessation of transmission to or from our services;
  • Any bugs, viruses, trojan horses, or the like, which may be transmitted to or through our services by any third party;
  • Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through our services.

Indemnification

You agree to defend, indemnify, and hold harmless EJay Mobile Services and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use and access of our services;
  • Your violation of any term of these Terms of Service;
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right;
  • Any claim that your actions caused damage to a third party.

Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
